To start foreign economic activity (FEA), an enterprise must be accredited at customs. The procedure for accrediting and keeping records of subjects of foreign economic activity is determined by the «Procedure for registering persons who, during the exercise of their activities, are participants in relations regulated by the legislation of Ukraine on customs business», approved by Order of the Ministry of Finance of Ukraine No. 552 dated 15.06.2015.

Who can be engaged in foreign economic activity in Ukraine

Any enterprise or individual entrepreneur has the right to engage in foreign economic activity (FEA). In order to export and import goods and services, you need:

  • undergo state registration of a legal entity or individual entrepreneur;
  • to include in the charter of the enterprise a clause on foreign economic activity;
  • register with the tax office;
  • open a hryvnia or foreign currency account;
  • pass accreditation at customs.

What is accreditation?

Accreditation is the registration of legal entities and individual entrepreneurs at customs, as a result of which the company receives a foreign economic activity registration card and is entered into the centralized customs register of the unified automated information system (UAIS). Accreditation is carried out in accordance with the «Procedure for registering persons who, during the exercise of their activities, are participants in relations regulated by the legislation of Ukraine on customs business».

The FEA registration number entered in the accreditation card is valid throughout the customs territory of Ukraine, the same number cannot be assigned to another subject of foreign economic activity, while one enterprise can have only one registration number.

The company is accredited once, but if any data (legal address, current accounts, information about responsible employees, etc.) changes, changes are made to the accreditation card.

Accreditation is canceled automatically after receiving information from the Unified State Register of Legal Entities, Individual Entrepreneurs and Civil Formations on the termination of the enterprise or after a written application from the business entity.

An account number can be obtained from any customs authority, but most often the procedure takes place at the place of registration of the enterprise.

How is accreditation going?

For accreditation, it is necessary to provide originals and certified copies of documents according to the list specified in the Order of the Ministry of Finance of Ukraine No. 552 dated 15.06.2015. Together with the documents, a completed accreditation card and its electronic copy are submitted.

Ways of submitting documents to the customs authority

  • upon a personal appeal of an entrepreneur, his representative or a customs broker who acts in accordance with an agreement between him and the entrepreneur;
  • sending paper copies of documents by mail;
  • sending electronic copies of documents to the UAIS by means of electronic communication;
  • entering data into the «Single Window for International Trade» on the official website.

Usually, the registration process begins the next day after the submission of documents and takes about a day.

When can an application be rejected?

The application is returned for revision in the following cases:

  • filed in violation of the requirements for filling it out;
  • inaccurate data has been entered into it;
  • the information in the application does not correspond to the data from the Unified State Register of Registration of Legal Entities and Individual Entrepreneurs;
  • the customs broker is not included in the centralized register of the UAIS.

In this case, the entrepreneur can apply to the customs authority again.

Refusal to register is received by enterprises that have already been entered in the customs register, as well as those about which there is data in the Unified State Register on the termination of entrepreneurial activity.
